Terms of Use

Who we are. SNOWL is the online learning platform of CIMAS, the Chikara Institute of Medicine and Allied Sciences. CIMAS and SNOWL are units of Ekaayi Healthcare Private Limited, a company registered in Delhi, India (GSTIN 07AAICE1964G1ZL), referred to below as "Ekaayi", "we", "us" or "our". The founder and owner of CIMAS is Dr Ankur Chikara. The platform is served at cimas.ekaayi.in, at snowl.in once connected, and through any SNOWL mobile application (together, the "Platform").

By creating an account, enrolling in a course, subscribing to a membership or otherwise using the Platform, you ("you", "the learner") agree to these Terms of Use, our Privacy Policy and our Refund Policy. If you do not agree, please do not use the Platform.

1. Eligibility and your account

1. You must be at least 18 years old, or use the Platform under the supervision of a parent or guardian who accepts these terms on your behalf.
2. You are responsible for the accuracy of the details on your account and for keeping your login credentials confidential. Everything done through your account is treated as done by you.
3. One account is for one person. Sharing an account, or sharing login details with others, is a breach of these terms and may lead to suspension without refund.

2. Courses, memberships and live classes

1. Courses are sold either one-time (access for the period stated on the course page, lifetime where stated) or through a membership (recurring subscription that gives access to a defined set of courses, question banks and live classes for as long as the subscription is active).
2. Memberships renew automatically at the end of each billing period (monthly, quarterly or annual) at the price shown on the membership page at the time you subscribed. Your plan price is locked while your subscription stays active. You can cancel renewal at any time from your account; access continues until the end of the paid period.
3. Content added to a membership while you are subscribed becomes available to you at no extra cost. Content withdrawn by a teacher may be removed with notice, as described in clause 6.
4. Live classes are scheduled in Indian Standard Time. Recordings, where offered, are made available on a best-effort basis and may be edited for quality.
5. Quizzes, question banks and mock tests give an indicative score only. They are study tools, not a prediction of performance in any examination.

3. Prices, taxes and payment

1. All prices are in Indian Rupees and include GST at 18% unless a page states otherwise. A tax invoice issued by Ekaayi Healthcare Private Limited (GSTIN 07AAICE1964G1ZL) is generated for every purchase and is available from your account. Learners buying for a GST-registered institution may enter the institution's GSTIN at checkout to claim input credit.
2. Payments are processed by third-party payment gateways. Where the checkout shows an internet handling or transaction fee, that fee is charged in addition to the listed price and is shown before you pay.
3. Access is granted once the gateway confirms the payment. If a payment fails or is reversed, access may be withdrawn.
4. Refunds and cancellations are governed by the Refund Policy.

4. Licence and acceptable use

1. We grant you a personal, non-transferable, non-exclusive licence to view the content you have paid for, on the Platform, for your own learning.
2. You may not download (except where a download button is provided), record, screen-capture, copy, redistribute, resell, publicly display or create derivative works from any video, question, explanation, document or image on the Platform.
3. You may not attempt to bypass access controls, scrape the Platform, upload malicious code, harass other learners or teachers, or post content in discussions and communities that is unlawful, defamatory or infringing.
4. Breach of this clause entitles us to suspend or terminate your account without refund and to pursue legal remedies.

5. Intellectual property

All content on the Platform, including courses, questions, explanations, slides, recordings, the SNOWL and CIMAS names, the owl mark and the series names (Charaka, Sushruta, Madhava, BC Roy, Subbarow and Anandi), is owned by Ekaayi Healthcare Private Limited or by the faculty who created it and have licensed it to us. Nothing in these terms transfers any intellectual property to you. Textbook references cited in explanations remain the property of their publishers and are cited for academic purposes only.

6. Faculty and teacher content

1. Some courses and memberships are created by visiting faculty under agreements with Ekaayi. Each teacher is responsible for the accuracy of their own teaching.
2. A teacher may withdraw their content from the Platform with notice. Subscriptions and purchases already made continue to be honoured until they lapse, or an equivalent replacement or a pro-rata refund is offered.

7. Medical education disclaimer

The Platform provides medical education for students, residents and practitioners. It does not provide medical advice, diagnosis or treatment for any patient, and no doctor-patient relationship is created by using it. Clinical decisions must be made by a qualified practitioner using current guidelines and the individual patient's circumstances. We take care to keep content accurate and referenced, but medicine changes and errors can occur; please report any error to helpcimas@gmail.com.

8. Availability and third-party services

The Platform is hosted on Graphy, a third-party learning-management service, and depends on payment gateways, email, messaging and video providers. We aim for continuous availability but do not guarantee it. Scheduled maintenance, outages at a provider or events beyond our reasonable control may interrupt access, and such interruptions do not entitle you to compensation beyond what the Refund Policy provides.

9. Limitation of liability

To the fullest extent permitted by Indian law, Ekaayi's total liability to you for any claim arising out of the Platform is limited to the amount you paid us in the twelve months before the claim. We are not liable for indirect or consequential loss, including loss of examination results, income or opportunity. Nothing in these terms limits liability that cannot be limited by law.

10. Termination

You may close your account at any time by writing to us. We may suspend or terminate accounts that breach these terms, after notice where practicable. Clauses 4, 5, 9 and 12 survive termination.

11. Changes to these terms

We may update these terms from time to time. The effective date at the top will change and material changes will be announced on the Platform or by email. Continued use after a change means you accept the updated terms.

12. Governing law and grievances

These terms are governed by the laws of India. Courts at New Delhi have exclusive jurisdiction. Before going to court, please write to our grievance officer so that we can try to resolve the matter within 30 days.
